These Terms govern your access to and use of the Website and the scope of services provided. By accessing or using the Website, or by commissioning design work, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not access or use the Website or our services.

1. Use of the Website

1.1 Licence

Subject to your compliance with these Terms, Blue Butterfly Flooring grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for personal, non-commercial purposes.

1.2 Restrictions

2. Scope of Service, Installation, and Liability

2.1 Design and Supply Services

Blue Butterfly Flooring provides professional flooring design, specification, and supply services. This service includes consultation, concept development, material selection, creation of floor plans or visualisations (“Design Services”), and the provision (supply and delivery) of the physical flooring product, which may be produced by an external third-party printer.

2.2 Exclusion of Installation

Blue Butterfly Flooring does not undertake, manage, or oversee the physical installation of any flooring product. The client is solely responsible for arranging, managing, and ensuring the quality of the installation through their chosen third-party fitter or contractor.

2.3 Installation Disclaimer

Blue Butterfly Flooring accepts no responsibility or liability for any defects, damages, costs, or losses arising from or related to the installation process, workmanship, or failure of the installer to adhere to manufacturer guidelines or industry standards. This includes, but is not limited to, subfloor preparation, fitting errors, or inappropriate use of the specified flooring.

3. Product Defects and Reporting

3.1 Initial Inspection and Defect Reporting

The client, or the client’s representative (including the installer), must thoroughly inspect all delivered flooring products immediately upon delivery and prior to any installation.

Any visible or material defects in the flooring product itself (e.g., manufacturing errors, incorrect product delivered, significant damage during transit) must be reported to Blue Butterfly Flooring in writing (via email to info@emilycampbell.co.uk) within seven (7) calendar days of the delivery date.

3.2 Consequences of Late Reporting

Failure to report defects within this seven (7) day period will be deemed acceptance of the product in its delivered condition, and Blue Butterfly Flooring will not be liable for any claims related to defects or damage that were apparent or easily discoverable upon delivery. Installation of the flooring constitutes final acceptance of the product and waives any claim for visible or material defects.

4. Intellectual Property

4.1 Ownership

The Website and its contents, including but not limited to text, graphics, logos, trademarks, and software, are the intellectual property of Blue Butterfly Flooring or its licensors and are protected by applicable intellectual property laws.

4.2 Trademarks

“Blue Butterfly Flooring” and the Blue Butterfly Flooring logo are trademarks of Blue Butterfly Flooring. You are not granted any right or licence to use these trademarks without the prior written consent of Blue Butterfly Flooring.

5. Third-Party Links

The Website may contain links to third-party websites or resources that are not owned or controlled by Blue Butterfly Flooring. We are not responsible for the content, privacy practices, or availability of such third-party websites.
